Data collected
- Account: email, password (hashed, never stored in plain text), first name, last name and, if you provide them, nickname, phone, company, country, city and postcode.
- Licence and subscription: product subscribed, dates, renewal status, payment provider used, and the consents given at checkout (date and version of the terms accepted).
- Processed files: the file you load into the application is sent to our server to apply the options you choose. Each time options are applied (previews excluded), a copy of the original file and of the modified file is kept in our storage, for tracking processing, support and improving the solutions. We also keep a history of each file written: SHA-256 fingerprint of the original file, detected ECU, options applied, number of bytes changed, date and time. This history feeds your modification reports. We also keep the count of tokens used each day.
- Information emails: campaign sends, unsubscribes and their open tracking through an invisible pixel (date of first opening and number of openings), unless you turned it off in your profile.
- Support: content of tickets (subject, messages, attachments).
- Technical data: IP address and connection logs, used for security and abuse prevention.
Payment
Payment is handled directly by Stripe or PayPal. NXT Solution never has access to your full card details: only the information needed to process the order (email, amount, product) passes through our platform.
Purposes and legal bases
- Account management, licence delivery, file history and modification reports, support: performance of the contract (art. 6.1.b GDPR).
- Keeping proof of orders and accounting records: legal obligations and legitimate interest (art. 6.1.c and 6.1.f).
- Copies of processed files, for tracking processing, support and improving the solutions: legitimate interest (art. 6.1.f).
- Sending information emails to customers: legitimate interest (art. 6.1.f), with unsubscribing at any time through the link in each email or from the profile.
- Open tracking of these emails: legitimate interest (art. 6.1.f), knowing whether our announcements are read; you can turn it off at any time from your profile.
- Security, prevention of fraud and account sharing: legitimate interest (art. 6.1.f).
Recipients and processors
Your data is never sold. It is accessible to NXT Tronic and to the following providers, each for its own part:
- Cloudflare, Inc. (United States): website hosting and anti-bot protection on forms (Turnstile).
- FreakHosting Ltd (Frankfurt, Germany): application server and database (accounts, licences, file processing, history).
- Ultra.cc (server in Canada): storage of copies of processed files.
- Stripe and PayPal: payment and subscription management.

Transfers outside the European Union
Cloudflare and Discord, and in some cases Stripe and PayPal, may process data in the United States. These transfers rely on the EU-US Data Privacy Framework or on the European Commission's standard contractual clauses, depending on the provider. Copies of processed files are stored in Canada, a country covered by a European Commission adequacy decision.
Retention
- Account, licence, history and copies of processed files: for the duration of the business relationship, then 3 years.
- Accounting records, proof of payment and consents given at checkout: 10 years.
- Information email sends and openings: 3 years.
- Support tickets: 3 years after the ticket is closed.
- Technical logs: 12 months at most.
Cookies
The site uses a technical session cookie (authentication, strictly necessary, not subject to consent) and Cloudflare Turnstile (anti-bot protection on the login and signup forms). No advertising or third-party tracking cookies are used.
Your rights
Under the GDPR, you have the right to access, rectify, erase and port your personal data, and to object to or restrict its processing. To exercise these rights, write to [email protected]. You may also lodge a complaint with the CNIL, the French data protection authority.
3. Terms of sale
These terms of sale govern the sale of access to the NXT Solution software, by subscription or for 30 days without a subscription, by Alexi Krzykawsky EI, trading as NXT Tronic, SIRET 10295686900014 (the "seller"), to its customers, whether businesses or consumers. Clauses marked "between professionals" only apply to customers buying for their business.
Ordering
Orders are placed from the customer area. Before paying, the customer accepts these terms by ticking the corresponding box, then requests immediate access to the software by ticking the second box. The order date and the version of the terms accepted are kept. A confirmation email restates the order and these consents.
Prices, subscription and payment
NXT Solution is sold as a subscription, monthly or yearly at the customer's choice, renewing automatically at the end of each period, or without a subscription, as 30 days of access paid once and never renewed. 30 days of access can only be bought when the customer has no access running: they are bought again once the previous access has ended, whether it came from a subscription or from an earlier 30-day purchase. Prices are in euros, VAT not applicable (art. 293 B of the French tax code). Each period is paid in advance, online, by card (Stripe) or PayPal. Any price change is announced by email at least 30 days before it applies to the next renewal; the customer may cancel before that date.
Each access, by subscription or for 30 days, includes every day 10 tokens for OFF solutions (EGR, FAP/DPF, AdBlue/SCR, IMMO and related) and 3 tokens for Stage 1 and FlexFuel. One token is used per solution applied to a file, and the fault-code table uses one OFF token per file. The preview does not count, and a solution applied again to the same file on the same day counts only once. Tokens are recharged every day at midnight (Paris time) and do not carry over from one day to the next. When a category has no tokens left, the application says so and does not apply the solution. These limits protect the work of developing the solutions and prevent an access from being used to process third parties' files.
In case of non-payment (failed renewal, rejected or disputed payment), access is suspended. Between professionals, in accordance with article L441-10 of the French commercial code, any amount unpaid when due bears late-payment interest at three times the legal interest rate, plus a fixed recovery fee of €40.
Access bought before 2 October 2026
Access paid before this version of the terms came into force, on 2 October 2026, stays without any token limit until the end of the period already paid. A subscription taken before that date keeps its price and stays without any token limit as long as it renews without interruption. After a cancellation, a new subscription follows the terms in force when it is taken.
Renewal and cancellation
The customer may cancel at any time, subject to the commitment described below, from the customer area, with the "Cancel your contract" button, then by confirming. The cancellation is confirmed by email. It takes effect at the end of the period already paid: access remains active until that date, with no further charge and no prorated refund. The customer may reactivate the subscription before that date.
The monthly subscription taken from 6 October 2026 carries a 3-month commitment, that is three monthly periods paid in advance. During the commitment the "Cancel your contract" button is not offered: it is offered as soon as the third month is paid, and the cancellation then takes effect at the end of that third month, with no renewal. All three months are due. After the commitment the subscription renews month by month and can be cancelled at any time, as stated above. The yearly plan runs for a year and has no further commitment. A monthly subscription taken before 6 October 2026 has no commitment. This commitment does not limit the rights the law gives a consumer customer, nor the cancellation provided for when the price or these terms change, to be requested by email to [email protected] during the commitment.
30 days of access without a subscription are not renewed: they end on their own, with nothing to cancel and no further charge.
For the yearly plan, a consumer customer is informed in writing, no earlier than three months and no later than one month before the end of each period, of the option not to renew (article L215-1 of the French consumer code). Without this notice, they may cancel free of charge at any time from the renewal date, and the amounts paid for the unused period are refunded.
Delivery
Delivery is digital only. Once payment is confirmed, an email is sent to the account address with a download link valid for 7 days, which can be regenerated at any time from the customer area. The software is accessed by signing in to the application with the customer account credentials.
Licence and account
A purchase, by subscription or for 30 days, does not transfer ownership of the software: it grants the customer a non-exclusive, non-transferable licence to use it, valid while the subscription is active or until the end of the 30 days of access. The account is personal to the customer. The following are prohibited: sharing credentials, using one account for several people or businesses, reselling, renting or redistributing the software, decompiling it, and any attempt to bypass its protection system.
The software is for processing the files of vehicles that the customer works on. Offering other professionals a remote file-modification service performed with NXT Solution ("file service") is prohibited without the seller's written consent. Clearly abnormal usage volumes may lead to a request for explanation.
Any breach of this article may lead to immediate suspension and then termination of the licence, without refund.
Vehicle owner's authorisation
The customer warrants that, for each vehicle whose file they process, they have the authorisation of its owner or lawful keeper. Immobiliser removal features (IMMO) are reserved for repairing a vehicle whose ownership is established (ECU replacement, lost keys, immobiliser failure). The seller cooperates with the authorities in case of suspected fraudulent use.
Processed files
The customer agrees that a copy of the files they process with NXT Solution (original file and modified file) is kept by the seller for tracking processing, support and improving the software, under the conditions set out in the privacy policy.
Right of withdrawal
A consumer customer normally has 14 days to withdraw. In accordance with article L221-28 13° of the French consumer code, this right can no longer be exercised once supply of the software has started, at their express request, before the end of that period and they have expressly waived their right of withdrawal. This is what the second box ticked when ordering does, and the confirmation email restates it. A business customer has no right of withdrawal.
Legal guarantee of conformity
A consumer customer benefits from the legal guarantee of conformity for digital content and services (articles L224-25-12 et seq. of the French consumer code) for the whole duration of the subscription or of the 30 days of access. In case of a lack of conformity, they are entitled to have the software brought into conformity or, failing that, a price reduction or termination of the contract with a refund. Defects can be reported to [email protected] or by ticket from the customer area.
Condition of the software and liability
NXT Solution works on engine map files that the customer's programming tool writes back to an ECU. The customer acknowledges and accepts that:
- any work on a vehicle's ECU carries an inherent risk of malfunction, hard starting, loss of the manufacturer's warranty or, in rare cases, engine damage;
- they use the software aware of these risks, and must take the necessary precautions (backing up the original file, checking the result before writing it back, calling on a professional if in doubt).
The seller fixes reproducible defects reported to it within a reasonable time. It is not liable for damage resulting from misuse of the software, handling errors, a pre-existing defect of the vehicle or ECU, or work on the vehicle by the customer or a third party.
Between professionals, the software is provided as is, with no guarantee of a specific result; the seller is not liable for indirect damage (loss of business, revenue or customers, third-party claims) and its total liability in connection with the sale of NXT Solution is limited to the amounts paid by the customer over the last 12 months.
Lawful use
For emissions-related features (EGR, DPF, AdBlue/SCR and similar), the customer undertakes to use the resulting file in accordance with the law in force in their country of use (competition vehicle, exclusive track or off-road use, or export outside jurisdictions where such use is prohibited). The customer is solely responsible for how they use the software and the files it produces, and indemnifies the seller against any claim or penalty resulting from non-compliant use.
Support and updates
The catalogue of solutions evolves: solutions are added, corrected or withdrawn, in particular to guarantee their quality. These changes are delivered automatically, with no extra charge or reinstallation, while access is active. A solution missing from the catalogue can be requested by ticket from the customer area, with the file attached, with no guarantee of delay or completion. Technical support is provided by email at [email protected] or through the ticket form in the customer area. Support replies Monday to Friday, 9 am to 5 pm (Paris time), except public holidays and occasional closures. Requests received outside these hours are handled afterwards, with a longer delay. The seller handles requests diligently but guarantees neither a response time nor a resolution time. This clause does not limit the legal guarantee of conformity.
Refunds
As access is provided immediately after payment, no refund is due once a paid period has started, subject to the legal guarantee of conformity and the other cases provided for by law.
Payment disputes
Before opening any dispute with their bank or PayPal, the customer is invited to contact support to look for a solution. A dispute opened on a period already provided leads to access being suspended for the duration of the dispute.
Changes to these terms
The seller may change these terms. The new version applies from the next renewal, after being announced by email at least 30 days in advance; a customer who refuses it may cancel before that date. For 30 days of access, it applies from the next purchase.
Disputes and governing law
These terms are governed by French law and written in French; the French version prevails in case of discrepancy with a translation. In case of dispute, the parties first seek an amicable solution. A consumer customer may bring a claim, at their choice, before the court of the place where they lived when the contract was concluded or where the damage occurred, or any other court with jurisdiction under the law. Between professionals, the courts of Valenciennes (France) have sole jurisdiction.
